Taking into account everything previously stated, any use of any materials on our Website or any part thereof without Del Systems’ permission will be considered an infringement of intellectual property rights, and upon the knowledge of any unauthorized use, Del Systems will undertake all the legal remedies available in order to protect its intellectual property rights.

Our logos displayed on the Website, including but not limited to the Del Sytems’ logo, and Website logo, are the exclusive property of Del Systems, who holds the exclusive right to use it and prohibit the use of it by any third party..Unless otherwise explicitly stated in these Terms of Use or Privacy Policy, it is strictly forbidden to use Del Systems’ or Website name, logo, or trade names without Del Systems’ prior explicit consent in writing.

Neither Del Systems nor User will be held liable for the violation of the Agreement in case any unpredictable event or circumstance beyond reasonable control prevents them from complying with any of their obligations stipulated by the Agreement. Such events include but are not limited to a force of nature, war, civil unrest, acts of terror, acts of a legislative or executive authority, strike, failure of internet, or other circumstance that may be qualified as a force majeure according to the applicable law.

7. Changes to Website and/or Terms of Use

Changes to Website. Our Website may be updated by Del Systems from time to time in accordance with Del Systems’ business and other legitimate interests. To use Website and Service, each User must comply with these rules of acceptable use:

• User must provide complete and true information for the purposes of newsletter subscription or inquiry submission.
• User must provide accurate and up-to-date information. The User has to use accurate contact information. Using false identity is strongly prohibited.

9. Severability

Invalidity or unenforceability of any provision of the Agreement found by the competent court shall not affect the validity of the remaining provisions of the Agreement, which will be preserved in full legal force and effect. If any part of the Agreement violates any applicable legal provision and consequently proves to be void, such part shall be deemed to have been amended for those specific circumstances and in that particular respect in which it is void, in order to comply with the law. Such amendments will be limited to the minimum necessary to make the Agreement valid, and the amended provision shall retain as much of its original meaning as possible.

10. Dispute Resolution

This Agreement will be governed, construed, and enforced in accordance with the laws of the Republic of Serbia, without regard to the provisions regulating the conflict of laws.

All disputes arising out of or in connection with Agreement shall be finally settled by arbitration organized in accordance with the Rules of the Belgrade Arbitration Center (Belgrade Rules). The number of arbitrators shall be one. The place of arbitration shall be Belgrade. The language to be used in the arbitral proceedings shall be English.

11. Entire Agreement

Provisions of Terms of Use, Privacy Policy and Cookie Policy, including all amendments (if any) represent the entire agreement between you and Del Systems regarding the subject matter hereof and supersedes all prior agreements and understandings between you and Del Systems, in written or oral form.

In case any discrepancy occurs between the provisions of the Agreement and any other agreement, understanding, representation, or information published on Del Systems Website or contained in any other materials or correspondence between you and Del Systems, this Agreement shall prevail.
